<p>
	10月19日，江苏苏州。第七届中国国际版权博览会开幕。据悉，中国国际版权博览会是国家版权局按照国际化、专业化、市场化原则举办的综合性国家级版权专业博览会，2008年创办至今，已举办了六届。</p>
<p>
	本届博览会以&ldquo;交流、合作、创新、发展&rdquo;为主题，参展单位和机构共计300余家，主宾国为韩国。</p>
<p>
	作为国内版权领域的最高奖项，也是中国国家版权局与世界知识产权组织（WIPO）开展的合作项目，每两年评选一次的&ldquo;中国版权金奖&rdquo;也在博览会上揭晓，文字作品《新华字典》，2008年出版以来，发行量超过700万册、出版国家和地区近40个、版本逾50个的文学作品《活着》，以及类电作品《平凡的世界》等获得作品奖。</p>
<p>
	通过博览会，我们可以看到，包括版权在内的知识产权正成为中国建设创新型国家和文化强国的重要支撑。今天，中国已初步建立起了既符合中国国情又与国际规则相衔接的版权法律体系，版权执法和维权力度不断加大，版权产业对国民经济贡献的比重持续增长。</p>
<p>
	蓬勃发展</p>
<p>
	据今年早些时候发布的《中国网络版权产业发展报告（2018）》，2017年，我国仅网络版权产业的市场规模就已经达到了6000多亿元，较2016年增长27.2%。</p>
<p>
	从总体情况看，2006年以来，中国版权产业行业增加值持续走高，2016年即突破了5万亿元，占GDP的比重也从6.39%提高至7.33%，而且，中国版权产业行业增加值名义增长速度整体上高于GDP的增长速度。</p>
<p>
	不仅如此，中国版权产业除了产业规模扩大外，在推动社会就业、促进外贸出口等方面也发挥了积极的作用。2006年至2016年，中国版权产业的城镇单位就业人数从762.92万人增长至1672.45万人，占全国城镇单位就业总人数的比重也从6.52%增长到9.35%；商品出口额也从1492.62亿美元增长至2416.74亿美元。</p>
<p>
	在宏观层面欣欣向荣之外，聚焦具体的行业发展，通过参会的单位，记者也看到了满满的信心。</p>
<p>
	作为曾经因为盗版&mdash;&mdash;尤其是音乐产品数字化以来&mdash;&mdash;冲击损失最大的音乐行业，如今已走上健康发展、逐步茁壮成长的道路：就拿中国音乐著作权协会的实际情况来看，2017年度，该协会整体业务情况不断向好，会员发展、许可收费、版税分配等都有明显增长，特别可喜的是，会员发展和协会许可收入迈上了新台阶，税前许可收入首次突破两亿元关口，比2016年增长了17%。</p>
<p>
	&ldquo;尤其是近两年来，整体的发展局面很不错。&rdquo;国际唱片业协会的郭先生说。由于实物和数字盗版的有效打击，版权（著作权）理念逐步得到认同，特别是80、90后，很多人都培养起了主动的付费意识。</p>
<p>
	除了付费意识，&ldquo;著作权人的维权意识也在提高&rdquo;。中国音乐著作权协会会员部的宋雪介绍说。2017年新加入著作权协会的会员人（公司、单位）就有405名，差不多占比协会会员总数的5%。行业良好的发展状况，&ldquo;主要和版权的生态环境总体持续向好有关。&rdquo;她说。</p>
<p>
	持续优化</p>
<p>
	据国家版权局版权管理司司长于慈珂介绍，中国版权保护工作不断地在取得新进展，版权法律制度体系也日趋完善：经过30多年的努力，目前，中国为建立版权法律制度先后颁布了一部法律、6部条例以及9个部门规章和44个规范性文件。另外，中国的版权司法保护强度在不断地提高，知识产权的审判体系也日趋健全。</p>
<p>
	除了宏观环境的改善，规范化的版权保护也在市场中成体系地发展起来：不仅有分门别类的各种协会直接参与版权人具体的权益维护工作，市场化运作的版权维护企业（事务所 ）也已规模化地发展起来。而随着企业的介入，在技术领域，版权贸易、版权监测保护工作等站上了新的台阶。&ldquo;现在我们可以便捷地向PC端、IPTV、OTT以及移动端分发业务。&rdquo;冠勇科技的吴冠勇声称，而且在版权监测保护层面，结合云计算技术、分布式存储技术以及大数据挖掘等技术，&ldquo;可以实现全作品、全平台、全时段网络版权监测。&rdquo;他说。</p>
<p>
	成熟的技术之外，版权保护的市场&ldquo;软&rdquo;环境也有了极大地改善。腾讯法务维权中心的林丹对此有切身的体会：&ldquo;几年前我打过一场官司，是关于音乐作品版权的。&rdquo;从事作品版权保护工作多年的她说。官司最后我们赢了，但仅得到100元的赔偿，根本没办法用人力、物力来衡量。&ldquo;现在不同了，2017年周杰伦作品的纠纷我们胜诉后，判罚的赔偿金有1万多元。&rdquo;更为关键的还不是罚金的问题，&ldquo;而是诉讼相对以前，只要证据充分，程序、过程&lsquo;简洁、明晰&rsquo;。而且因为著作权人维权意识的普遍提高，众多的维权诉求我们可以集中分类，将同类案件进行打包处理，成本效益比显著改善。&rdquo;她说。</p>
<p>
	的确，由于版权生态环境的改善，不仅运营相关业务的单位（企业）经营生态趋好，而且版权人的主动性和积极性也大为提高&mdash;&mdash;&ldquo;懒得打官司&rdquo;状态正渐渐成为过去的风景。</p>
<p>
	由此，进而形成了版权保护的良性循环，反过来又促进了版权维护全链条上的相关工作。</p>
<p>
	维权依旧在路上</p>
<p>
	尽管版权产业、版权保护工作有了质变式的进展，但仍旧&ldquo;任重道远&rdquo;。</p>
<p>
	目前，虽然自觉的付费意识已经被新生代接受，并且，随着技术的进步和成熟，之前盗版的重灾区&mdash;&mdash;网络世界&mdash;&mdash;逐步得到净化。但&ldquo;习惯&rdquo;了免费&ldquo;分享、共享&rdquo;的心理仍然顽疾般存在。</p>
<p>
	好在和以前相比，&ldquo;不管是网店还是网站，只要你提出诉求，很快都会得到回应。&rdquo;山东一位不愿意透露姓名的出版人说。现在网络监测迅捷，相对来说比较容易发现盗版行为。但是，在实物市场，&ldquo;很多事情不是太好办。&rdquo;这位先生说，仅今年他们就遭遇了几起学校使用盗版文本的事件，可因为是公立单位，交涉过很多次，虽然盗版商品停止使用了，但由于无法找到源头的盗版生产者，总是按下葫芦又浮起了瓢，哪有那么多人和精力满世界盯着跑啊？！可&ldquo;人家不说，我们又没有侦讯调查权，一点办法都没有。&rdquo;找过执法部门，但这种&ldquo;小事&rdquo;通常不在他们关注的范围，&ldquo;没啥办法。&rdquo; 这位先生说。</p>
<p>
	实际上，在技术方面，也是道高一尺魔高一丈。&ldquo;新的技术层出不穷，&rdquo;吴冠勇说。不光是破解加密，还有技术隐匿的传送，等等，盗版的也是技术行家，&ldquo;警察与小偷&rdquo;现在更多的是斗智。</p>
<p>
	事实上，著作权的民事案件近年来也是成上升趋势。据中国最高人民法院颁布的《中国法院知识产权司法保护状况2017》显示，2017年地方各级人民法院共新收和审结知识产权民事一审案件20多万件和19万多件。其中，新收著作权案件数量为13万多件，同比上升57%，占2017全国地方各级法院新收知识产权民事一审案件总数的68%。</p>
<p>
	当然，数据本身并不意味着单纯的侵权行为增长，其中也有著作权人维权意识的提高&mdash;&mdash;更多&ldquo;懒得打官司&rdquo;的人加入到维权队伍中。</p>
