专利申请权转让有两种情形：<br />
&nbsp;<br />
一是在向专利局提出专利申请之前，发明人或设计人可以将自己申请专利的权利转让给他人；<br />
&nbsp;<br />
二是发明人或设计人已经向专利局提出了专利申请，但还未拿到专利授权书之前，可以将自己的专利申请权转让给他人。 &nbsp;<br />
&nbsp;<br />
这两种情况的本质都是专利申请权的权利主体发生的改变，不同点是两者发生时所处的专利申请阶段不同。但需要注意的是，无论在什么阶段转让专利申请权，转让双方都要订立书面合同，并向国务院专利行政部门登记，由国务院专利行政部门予以公告，否则就不是真正意义上的专利申请权的转让。 &nbsp;<br />
&nbsp;<br />

A和B双方约定，B将其非职务发明专利申请权转让给A，由A自主办理专利申请，B放弃专利申请权；A支付给B专利申请权转让费20万元，其中，合同签约后预付10万元，合同公证后补付10万元；合同签字生效后，即由A到国务院专利行政部门办理公证手续。合同还约定，以后不论A在生产中的经济效益如何，B无权再要求A支付报酬，亦不承担经济退回风险。 &nbsp;<br />
合同签订后，A分两次支付给B转让费15万元，但未按合同规定办理公证手续。B认为A未按约支付转让费，便向国家知识产权局专利局提出专利申请。后来，B申请的专利经国家知识产权局专利局公告。据此，A向法院起诉，要求B返还转让费15万元，并赔偿违约金3万元。&nbsp;<br />
&nbsp;<br />
<strong>订立书面合同 &nbsp;</strong><br />
在上述案例中，A和B虽然签订了书面合同，但是未到国务院专利行政部门登记，并未由国务院专利行政部门予以公告，所以并不是真正意义上的专利申请权的转让。 &nbsp;<br />
因此，在转让专利申请权的时候，在依法订立书面合同后，千万不要忘记到国务院专利行政部门进行登记，由国务院专利行政部门予以公告，以免引起纠纷。<br />
