商标恶意抢注行为的本质就在于通过抢注行为，窃取他人的劳动成果。目前，国内商标市场恶意抢注行为时有发生，职业抢注人甚至已将抢注名人商标、知名网站商标等做成了一条完整产业链。一些职业抢注人成立多家公司，以不同名义抢注国内外已经为相关公众知晓的商标并进行兜售。商标恶意抢注首当其冲损害了被抢注人的合法权益，已经成为严重影响企业品牌发展的一大因素。<br />

为应对商标恶意抢注行为，权利人要建立商标&ldquo;防火墙&rdquo;，不但要防止商标被恶意抢注，而且在遇到商标恶意抢注时更需充分利用法律武器积极应对。首先，商标注册手续要尽早完成，在计划进行品牌推广时就应该着手注册，避免以后遭&ldquo;小人之手&rdquo;，这也是最经济的商标权益保护方法。同时，保留商标使用和品牌推广证据，以备不时之需。此外，要充分了解并掌握商标法和不正当竞争法等相关法律政策，在品牌具有一定知名度时申请驰名商标保护，扩大商标专用权保护范围，积极监视市场，在发现商标抢注行为时尽快提出异议，避免自身合法权益遭受损害。<br />

我国必须依法大力遏制商标恶意抢注行为，强化知识产权的保护。首先，要切实增强商标保护意识，制定完善系统的商标品牌保护方案，从产品、服务、外观设计到企业网站、域名、产品图片、广告语等在内的诸多知识产权都要申请保护，全面维护企业的知识产权。同时，要建立完善有效的商标战略保护体系，特别是在机械制造、IT、电子产品等行业，针对附加值高、技术含量较大的产品，要建立优先保护的制度，为实施商标品牌战略保驾护航。<br />
